By accessing and using AImageResize ("we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations. If you do not agree with any part of these terms, you must not use our service.

Description of Service

AImageResize provides an AI-powered image resizing and outpainting service that allows users to upload images, specify target dimensions, and use artificial intelligence to intelligently expand image backgrounds.

User Accounts

To access certain features of our service, including AI resizing capabilities, you must create an account. You are responsible for maintaining the confidentiality of your account and password and for all activities that occur under your account.

You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

Credit System & Payments

Our service operates on a credit-based system:

• Free Tier: New users receive 3 free AI generations upon sign-in.
• Paid Tiers: Additional credits can be purchased in various packages (Lite, Starter, Pro, Power) as described in our Pricing section.
• No Expiration: Credits do not expire and remain available until used.
• Non-Refundable: All credit purchases are final and non-refundable, except as required by law.

Payment processing is handled by secure third-party providers. We do not store your payment information on our servers.

User Responsibilities

As a condition of your use of the service, you warrant that you will not use the service for any purpose that is unlawful or prohibited by these terms. You agree not to:

• Upload images that violate any intellectual property rights
• Upload illegal, harmful, offensive, or inappropriate content
• Attempt to reverse engineer, decompile, or disassemble any part of the service
• Interfere with or disrupt the service or servers connected to the service
• Use automated systems to access the service in a manner that sends more request messages than a human could reasonably produce in the same period

Intellectual Property

The service and its original content, features, and functionality are and will remain the exclusive property of AImageResize and its licensors. The service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

You retain all rights to your uploaded images. By using our service, you grant us a limited, non-exclusive, royalty-free license to process your images solely for the purpose of providing our service to you.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the service without our express written permission.

Third-Party Links

The service may contain links to third-party websites or services that are not owned or controlled by AImageResize. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such website or service.

Disclaimer of Warranties

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE MAKE NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, OR THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; NOR DO WE MAKE ANY WARRANTY REGARDING THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE, OR THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICE.

Limitation of Liability

IN NO EVENT SHALL AIMAGERESIZE, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (III) ANY CONTENT OBTAINED FROM THE SERVICE.

OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR USING THE SERVICE DURING THE SIX (6) MONTHS PRECEDING THE DATE OF THE CLAIM.

Indemnification

You agree to defend, indemnify, and hold harmless AImageResize and its subsidiaries, affiliates, officers, agents, employees, and partners, from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of the service or your violation of these Terms.

Termination

We may terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the service will immediately cease. If you wish to terminate your account, you may simply discontinue using the service.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any claim or dispute between you and AImageResize arising out of or relating to these Terms shall be resolved exclusively in the federal or state courts located in California, and you hereby consent to and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to such courts.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the service.
